Terms of Service

These Terms of Service (“Terms”) govern your access to and use of NicheXML (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service is operated by an individual provider based in Greece (the “operator”, “we”, “us”). Invoices are issued personally by the operator in accordance with Greek law applicable to sole-trader services.

1. The Service

NicheXML lets you convert spreadsheet data (Excel, CSV) into XML files validated against an XSD schema. You may use built-in target schemas provided by us, or upload your own.

2. Your account

• You must be at least 18 years old to create an account.
• You must provide accurate information at signup and keep it up to date.
• You are responsible for keeping your password confidential and for all activity that happens under your account.
• One account per person. Using disposable email services is not allowed.

3. Subscriptions and billing

3.1 Plans

The Service is offered on monthly subscription plans. Current plans and prices are shown on the Pricing page. Each plan has a monthly conversion allowance which resets at every billing cycle.

3.2 Payments

Payments are processed by Stripe. By subscribing, you authorise Stripe to charge the payment method you provide, on the day of subscription and on each renewal, until you cancel.

3.3 Plan changes

Upgrades take effect immediately; your card is charged the prorated difference for the remainder of the current billing period. Downgrades also take effect immediately for feature access, but the price change applies from the next renewal — no refund or credit is issued for unused time.

3.4 Cancellation

You can cancel any time through the Stripe billing portal accessible from the Pricing page. Your subscription remains active until the end of the billing period already paid; no refund is issued for the unused portion of a paid period.

3.5 Refunds

Except where required by consumer-protection law, all payments are non-refundable. Failed XSD validations do not count against your monthly conversion quota — you are only debited for conversions that actually produce a valid output.

3.6 Free trial

Each new user receives one (1) free conversion at signup after email verification. The free trial is available only once per person.

4. Your content

You retain all rights to the data you upload (the “Content”). You grant us a limited, worldwide licence to store, process, and transform your Content solely to provide the Service. Uploaded files and generated XML are automatically deleted after 30 days.

You represent that you have the necessary rights to the Content you upload and that its use through the Service does not violate any law or third-party rights.

5. Acceptable use

You must not:

• Upload content that is illegal, infringes third-party rights, or that you have no right to process.
• Use the Service to send spam or to distribute malware.
• Attempt to interfere with, reverse-engineer, or gain unauthorised access to the Service or other users’ accounts.
• Abuse trial credits by creating multiple accounts.
• Automate account creation or use the Service beyond reasonable rate limits.

We may suspend or terminate an account that violates these rules, with or without notice.

6. Availability and support

We strive to keep the Service available, but we do not guarantee uninterrupted operation. Planned maintenance is announced when reasonably possible. Support is provided by email at support@nichexml.com.

7. Intellectual property

The Service — including its software, design, and branding — is owned by us and protected by intellectual-property laws. Nothing in these Terms transfers ownership of the Service to you.

8. Limitation of liability

The Service is provided “as is” and without warranties of any kind, express or implied. To the maximum extent permitted by law:

• We do not guarantee that the generated XML will be accepted by any specific third-party system.
• You are responsible for verifying the output before submitting it to tax authorities, marketplaces, or trading partners.
• Our total liability for any claim arising from the Service is capped at the amount you paid us in the 12 months preceding the claim.
• We are not liable for indirect, incidental, or consequential damages.

Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Termination

You may delete your account at any time from the profile page. On deletion, your personal data is removed as described in the Privacy Policy. We may terminate or suspend accounts that violate these Terms or applicable law.

10. Governing law and jurisdiction

These Terms are governed by the laws of the Hellenic Republic (Greece). Any dispute arising from these Terms shall be submitted to the competent Greek courts, unless mandatory consumer-protection law provides otherwise.

11. Changes

We may update these Terms from time to time. Material changes will be notified by email at least 14 days before they take effect. Continued use of the Service after that period constitutes acceptance of the updated Terms.
